When a person is injured in an accident that is not their fault, they commonly make an accident claim these days. In order to compensate the victim for the loss suffered as a result of the accident, the claim aims to win monetary compensation. The money won in compensation is incredibly important to those accident victims who have been forced to take lengthy periods of time off work in order to recover and have lost earnings as a result. Many an accident claim results from a slip, trip or road accident. But many people each year are injured, sometimes seriously by defective products.
Because the provider or a product or a service has a legal duty to protect the consumer from accident or injury, the victim of any such accident is protected by law. This is comparable to local council’s duty to ensure members of the public are protected from such dangers as potholes or loose paving stones.
When solicitors talk about defective products or services, there is a great variety of the sorts of things they are referring to. Injuries could arise from defective work tools, food poisoning after eating out, faulty home equipment, furniture or toys, dangerous cars, inadequate car repairs or carbon monoxide poisoning, amongst many others.
In the event of making an accident claim, the accident claim specialist will start the process by identifying the person who was legally responsible for the defective product or service. The person responsible could be one of a long list including the manufacturer, the importer, a landlord or an employer.
Having identified the person responsible, the accident claim solicitor will obtain a medical report of the injuries obtained. This is very important because it acts as evidence in the claim. Further evidence might be a technical report from an expert detailing the product’s defects.
Following the gathering of evidence, the accident claim solicitor will pursue compensation as the victim’s representative. This allows the victim to take a step back from the complexities of the accident claim and concentrate on their recovery.
