Losing an arm in a job-related accident entitles a laborer to the maximum workers compensation benefit by law. This means the injured laborer would earn $400 per week for 312 weeks in the state of New York. This inconsistency is present as the result of a regulation enforced back in 1914 that saw over workers compensation. This regulation designates the amount of benefits given for the loss of hearing or for a body part. Benefits are paid continuously for injuries resulting in partial or permanent disabilities which are specifically cited in the law. This has led to a workers compensation system that pays a disproportionate percentage, nearly 70 percent, to a mere 13 percent of all workers compensation matters. For the state of New York, this has also led to a workers compensation premium that is 72 percent higher than the national average. Though on the opposite end of the spectrum , New York's benefit limit of $400 per week is one of the lowest in the area. On the other hand, New York's local governments have already started to deal with the two aspects of the system. At one time, Texas, as an example, was notorious for having a broken down system. The program needed to make some modifications, as it ranked third in terms of workers' compensations expenses, while ranking first in terms of number of workers harmed on the job.
Another problem in Texas was the growing dropout rate of doctors. This cause the government to respond by adjusting the laws in order to generate new networks of physicians, and pay slightly more benefits to workers who has been injured. Also suggested was the possibility of upping the maximum payout to a weekly $500. Experts estimate that by implementing both of these changes, premium costs could be cut by approximately 15%.
New York is hoping that other ideas will be presented and considered so they can raise the benefits for qualified injured workers even further. The clear answer to finding a solution to equalizing workers comp benefits is discovering where this middle ground is. Open-ended cases of back pain will be ended.
New York need only look to California, a state which has already made such changes to its laws. In California, the petition drive was initiated in order to place the question onto the actual ballot. Faced with a constituency that clearly favored changing the law, state legislators were forced to rewrite worker's compensation.
In order to reach workers compensation reform within New York without options for a petition drive, the key is to force leaders in the legislation to take action. Local legislators must let their leaders know that struggling businesses and stressed local governments see this as a priority.
